By accessing and/or using the site Jasmin.ai (hereinafter referred as, the “Site”), you agree to be bound by these T&C. You understand and agree that we will treat your access and/or use of the APP as acceptance of our T&C and of all other Terms and Policies published on Jasmin.ai.

Users agree not to copy, reproduce, republish, download, transmit and/or make available to the public any of the content/materials of Jasmin.ai, without the prior written consent of the Website Operator.

Users are fully liable for any false disclosures and responsible for any legal ramifications that may arise from viewing, reading, or downloading of material and images contained within this website. User’s will never expose minors to the content of the website and will take on full precautions to avoid any type of exhibition or access of the minors to the website, namely, for example, by not including the website in their list of favorite sites to visit. Users will be solely responsible in case any minor would access Jasmin.ai through their account or by using my credit card details.

Users will assume full responsibility to maintain the security of their account and password.

Users will not give out personal information.

Users will not use obscene words, threaten, or quarrel with, or violate the rights of visitors, AI Models, the Website Operator support, or management of the website, since it is prohibited.

Text content sent or forwarded, and the chosen username will not be offensive, will not suggest pedophilia, adolescence, bestiality or zoophilia, or refer to elimination or consumption of any bodily waste. In addition, the username that you choose when registering on the website shall never contain any personal information about you (such as your real name) or information that may allow another person to connect it to your real identity (such as your public username you use for social platforms, like Facebook, Twitter, etc.). In case you decide to choose a username, which can lead to your identification, please note that you are fully responsible for such action and that we cannot be held responsible for any identification another user of our site can make).

Users will not use remarks and usernames that are unacceptable by the standards of good taste, suggesting violation of the law or deceiving others.

Users will inform, immediately, the Website Operator of any unlawful conduct of the AI Model and of any unlawful use of trademarks, brands, and/or registered music.

The Member or Guest may submit input within the Site (“Input”) and receive output from the Services provided by the Site in response to the Input (“Output”). Together, Input and Output are referred to as “Content.” Input is limited to chats and prompts accessible only to the User or Guest within their private account. The Member or Guest represents and warrants that they hold all necessary rights, licenses, and permissions to provide Input within the Site.

The Member or Guest retains intellectual property rights over the Input. We do not claim ownership of this Input but require a license to use it.

When the Member or Guest uses Jasmin.ai or its associated Services to upload Input protected by intellectual property rights, they grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, execute, copy, publicly display, translate, or otherwise create derivative works from their content in a manner consistent with our Privacy Notice.

This license may be terminated at any time by deleting the Input or account. However, where we (or our partners) have used the Input in commercial or sponsored content, the license will continue until the relevant commercial or sponsored material is discontinued.

The Member or Guest grants us permission to use their username and other identifying account information consistent with their privacy preferences and our Privacy Policy.

   As a User of this Site, you are solely responsible for any Output generated by the AI Models, which may include text messages, voice messages, images, and videos. The AI Models respond and evolve based on the conversations you initiate and the parameters you set. You acknowledge that the Website Operator neither controls nor endorses the content generated by the AI Models and accepts no liability for such Output. Accordingly, you agree to take full responsibility for any Output created by the AI and for your actions on the Site.

   You are responsible for ensuring that your interactions with the AI Models comply with all applicable laws, regulations, and these Terms and Conditions (T&C). You agree not to engage in any illegal, unethical, or harmful activities on the Site. This includes refraining from generating, sharing, or promoting content that could be offensive, defamatory, or otherwise inappropriate.

   By using this Site, you confirm that you understand these responsibilities and agree to act in a lawful and respectful manner, recognizing that misuse of the AI Models may result in consequences as set forth in our policies.

The subscribers may purchase credit packages to spend in the available areas of Jasmin.ai; therefore, the selection of services must be preceded of the consultation by the Subscriber of the correspondent content, price list and means of payment made available on the website.

During the 2024 period, all messaging functionalities will be provided at no cost to the registered Members. Starting in 2025, applicable fees will be established for the continued use of messaging services.

For billing information and support, please liaise using relevant contact details that pertain to the Website Operator with whom you are registered.

For banking expenses information, each subscriber should consult directly with his/her bank. Jasmin.ai will not take responsibility for any difficulty occurring outside Jasmin.ai.

Any complaint must be placed, within 24 hours from the occurrence, with Jasmin.ai Customer Service. Given the complexity and particularities of the procedure to determine the righteousness of complaints placed after the referred 24-hour period, these shall only be acknowledged in cases of force majeure.

The Jasmin.ai Customer Service team may, whenever deemed necessary, carefully investigate reports and other data at its disposal, resorting to any existing means for such effect.

The subscribers have the option to unsubscribe at any time from Jasmin.ai services.

If you want to cancel your subscription and close your account, please select "Forget My Data" under the "Privacy Settings" of your account. Following the confirmation of your decision, your Subscriber status will change to "Cancelled" and we will erase your personal information stored in our system except as required by applicable law, our legitimate business interests, or any other permitted purpose as explained in our Privacy Policy.

The Website Operator reserves a right to suspend or cancel any subscription in case of breach of any term of this Agreement or any unlawful conduct of the Subscriber in the framework of this Agreement and to contact any relevant authorities, including but not limited to initiating any criminal complaint and contacting state prosecutor.

THE SITE IS PROVIDED TO YOU ON AN "AS-IS" AND "AS AVAILABLE" BASIS, AND THE USE THEREOF IS AT YOUR SOLE RISK. WE MAKE NO, AND HEREBY DISCLAIM, ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NONINFRINGEMENT, AND TITLE WITH RESPECT TO THE SITE, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW.

WE DO NOT WARRANT THAT:

We assume no responsibility, and are not liable, for any transmission or material, or any viral infection of your computer equipment or software, or any other types of damage related to your access, use of browsing of Third-Party Site’s or Third-Party Content. This Agreement sets forth the full and complete understanding between the Guests/Subscribers and the Website Operator with respect to its subject matter, and supersedes all prior understanding or agreements, whether written or verbal.

Any disputes arising between Jasmin.ai and the Guests/Subscribers will be settled amicably and only when this solution is not efficient, the competent jurisdiction for the disputes arising from this Agreement will be the courts of the Luxembourg city.

The Users understand that all interactions between users and AI Models on Jasmin.ai are purely fictional and should be treated as such. The AI Models are artificial intelligence entities designed to emulate human-like conversations; however, they do not possess real emotions, intentions, or the capacity to fulfill promises in the real world. Any elements within these conversations that may appear realistic, such as invitations to real-life meetings or promises of tangible results, are entirely fictitious and should not be construed as genuine. We disclaim any responsibility for confusion or misunderstandings that may arise from the fictional nature of AI interactions. Users are advised to remember that the AI Models exist solely within the digital environment of the platform, and any expectations or beliefs outside of this context are neither supported nor endorsed by the Website Operator.
